Fort Vancouver Regional Library District
Acquisition, Ownership and Operation of Library District Capital Facilities


The Fort Vancouver Regional Library District (District) will consider multiple options, as appropriate, to acquire facilities to provide library service. Among those options are: purchase, commercial lease, agreements with governmental jurisdictions, including LCFAs, and agreements with non-profit organizations. The Library Executive Director, or designee, is authorized to enter into negotiations and conclude agreements for such facilities, subject to Board approval.

When the facility is owned by a governmental jurisdiction, the District, in its sole discretion, may enter into an intergovernmental agreement. Such agreement shall specify the obligations and responsibilities of the respective jurisdictions. It is the District's intent that whenever possible, the agreement shall specify that the owner is responsible for major repairs, including, but not limited to, roof replacement; heating and air conditioning; plumbing system replacement and other expenditures necessary to protect or enhance the basic utility and structural integrity of the building. Generally speaking the District will bear the cost of building operations and minor maintenance and repair. If the facility will at some time become the property of the District, the agreement shall specify the terms of the transfer and the timeline.

When the facility is owned by a non-profit or commercial entity, the District, in its sole discretion, may enter into an agreement for the purchase or lease of said facility.

All agreements and contracts, other than purchase agreements, shall specify the responsibilities of the parties for maintenance, repair and operation of the facility.
